The aim of this course is to expose students to the theoretical frameworks from sociology that are used to examine how the law shapes society and society shapes the law. The course will be structured into two parts. The first one will cover: a) The discipline approach; b) The concept of legal culture and the concept of legal socialization; c) The production and implementation of legal rules. The second part will then be devoted to the socio-legal analysis of the Justice system and Socio-legal analysis of penalty.

The course aims to provide students with the basic knowledge of the discipline, the ability to analyse law as social phenomenon, and to understand the relation between law and the others social phenomena. To reach this objective students will be introduced to: a) the discipline approach; b) its main concepts; b) the socio-legal analysis of the Justice system; d) the socio-legal analysis of penalty.

The class meets twice a week for three hours sessions. Most classes will be comprised of a brief (10 to 15 minutes) recap of what was covered in the prior class and about 2 hours of lectures and seminars to frame the readings for the week and situate them within a theoretical paradigm or scholarly debate. Students are invited to open and contribute to the classroom discussion.

For students who have in their teaching load the 6-7 CFU exam, the program is limited to Part One (entirely) and Part Two (limited to chapters 1 and 2) of the Book Lineamenti di sociologia del diritto, edited by Amedeo Cottino, Zanichelli, Bologna, 2019.

The exam will be an oral examination in order to verify the learning of the concepts and theories, the property of language and critical analysis as well as clarity and completeness. Students must demonstrate that they have acquired knowledge of the fundamental concepts and themes of the sociology of law and analyse the legal phenomena from a sociological point of view. The criteria for the evaluation of the test will be the following: a) Accuracy b) Completeness c) Clarity and appropriate vocabulary. Active participation during lectures is also well evaluated for examination purposes.

The sociology of law completes the students' theoretical training by adding the sociological perspective and sensitivity to the philosophical (philosophy of law) and legal perspectives. The theoretical origins of the sociology of law will be analysed together with the method and aims of the discipline, with the contribution of some authors whose some readings will be provided. Extended programme: 1. Sociological approach to law; 2. Normative messages; 3. Internal and external legal culture; 4. Normative socialisation' process; 5. Production of law and the legislative process; 6. Laws implementation process; 7. Constructivist approach: how crime is constructed; 8. Law and rights: legal pluralism.

Students should be able: a) to understand the basic concepts and topics of the sociology of law and b) to analyse legal issues from a socio-legal perspective.
