The Course will be developed through three sections.

The first section will be devoted to an illustration of the principles of Public Law in the modern era and to the historical and political events that led to the approval of the Constitution of 1948; the second and the third sections will focus on two general topics, the Organization of the Republic and the Rights and duties of citizens, respectively.

In particular, in the first part the course will focus on: Constitutions and Constitutionalism; Forms of State and Forms of Government; the Italian Constitutional history.

In the second part will focus on: the People and the elections; the Parliament; the Executive and the Administration in Italy; the President of the Republic; Regions and local autonomies; the judicial branch; the Constitutional Court; the sources of law in the Italian legal system;

Finally, the third part will focus on the: Civil liberties; Political and Social rights

The general aim of the course is to provide students with the tools to understand and master the main concepts of contemporary Italian public law.

Moreover the course aims to provide:

Knowledge of the fundamental features of the Italian constitutional system, with particular regard to the sources of law, to the structure and functions of the Constitutional bodies and to the Constitutional system of freedoms and rights;
Ability to deal with the main issues of the contemporary public law, starting from a correct identification of the current legislation;
Development of an indipendent judgment and of an ability to apply the acquired knowledge.

Good knowledge of the history of Italy, particularly regarding the transitional phase 1945-1947.

Face-to.face lessons

IT'S IMPORTANT TO KNOW THAT:
Starting from 1st January 2023 the exams, according to art. 35 of the Regolamento di Ateneo the student is allowed to appear at the roll call no more than three times (it is the same for insufficient, absent or withdrawn).

The assessment method adopted is a written examination based on multiple-choice questions

Presentation of the course; forms of State and government; theory of legal sources; constitutional sources; law and government’s legal force; the other sources of law in the Italian legal system; international law sources and EU law sources of law; People, citizenship and foreign status; direct end representative democracies; electoral laws; Parliament; Govenment; The Head of the State; The Authomonie: Regions and Municipalities; European Union; the currency: The budget of the State and the coordination of public finance; the judiciary and the judicial function; Public administration; rights and duties of citizens; positive and negative freedoms; Economy, labour, business and consumers.
GENDER MAINSTREAMING
In the discussion of the programme, particular attention is dedicated to gender mainstreaming. Reflection works in a transversal way: gender mainstreaming will be taken into consideration with regards to equality principle (formal and supportive); political participation rights; choices concerning the body; equality, merit and well-being in the field of employment, education and pay.

Knowledge of the fundamentals of the general theory of the sources of law and interpretation;
Knowledge of the system of sources of law of the Italian and international legal systems;
Ability to solve some basic problems related to the relationship between the sources of law, conflicts and the techniques of resolution;
Knowledge of the Constitutional organization of the Italian Republic;
Specific and Transversal skills:

Learning and proper use of basic techniques of legal reasoning to solve problems;
Knowledge and use of proper legal terminology;
Ability to analyze legal sources, doctrinal and jurisprudential materials related to public law.
