The course aims to reconstruct the role of labour law as an engine for the development of the territory, not only in economic terms but also from a social and environmental point of view. The lessons are organised into three thematic areas dedicated to the main players involved in this process, of a public, private and trade union nature (public administration, local authorities, social and health facilities; private companies and third sector entities; trade unions and trade associations). On the one hand, the course will analyse the network of exchanges and virtuous relations for the welfare of the community involving some of these protagonists, especially through collective bargaining. On the other hand, the course will reconstruct the set of rules that guides the conduct of labour relations, in order to provide students with in-depth knowledge of the internal workings of these actors, also in terms of human resources management.

Provide students with adequate knowledge of the regulations governing labour relations and trade union law; provide students with the tools to apply the rules and institutes to practical cases.

The general prerequisites.

The course is organized into lectures. Attendance is not mandatory but is strongly recommended in order to acquire, including through classroom activities, a greater mastery of the subject, the legal vocabulary and understanding of the legislative texts technique that from time to time are analyzed.

The examination consists of a written test lasting 45 minutes. Candidates will have to answer four ‘open’ questions in which they are asked to correctly and comprehensively reconstruct some of the institutes covered by the course and to correctly interpret and apply them. In particular, the aim is to test knowledge of the regulations, the ability to process and organise data and notions learned and the ability to apply the discipline in solving practical cases. Each answer is awarded between 0 and 7.5 points. The test is deemed passed if the overall mark is not less than 18 points.

Part I - The Public Administration: social security measures and active labour policies in the Italian legal system; employment in the P.A.; labour relations in the local authority sector; labour relations in the health sector. Part II - Private enterprise and entities from “terzo settore”: sustainable enterprise; corporate welfare; employment in private enterprise; entities of “terzo settore”; employment in the so-called “terzo settore”. Part III - Territorial social bargaining: the new role of the trade union in the territorial community; social concertation; welfare policies; the so-called clusters. Integration of gender issues: one lesson of the course will be dedicated to reconstructing the main profiles related to gender equality from a labour law perspective.

At the end of the course the student will be able to correctly identify the sources of discipline (collective agreement or law) of the individual institutions and will be able to give correct interpretation and application.
