Course Contents
The course will illustrate the theoretical foundations of labour law with an analysis of the main case law trends.
The course will cover, almost entirely, the labour law discipline, which will be analysed in an overall view, in order to favour the understanding of the fundamental junctures of the field.
Reference Texts
F. Carinci, R. De Luca Tamajo, P. Tosi, T. Treu, Diritto del lavoro, 2. Il rapporto di lavoro subordinato, Utet, Torino, latest edition available
Learning Outcomes
The course aims to illustrate the essential notions of labour law, as well as to provide a clear understanding of the dynamics related to the employment relationship.
The purpose is to provide the student with a solid conceptual basis, a clear and up-to-date notion base and a secure mastery of the technical-specialist language. By paying constant attention not only to theoretical debate, but also to jurisprudential interpretation, the course aims to provide students with a conscious and critical approach, which allows them to understand and contextualise the main aspects of the labour law in a legally correct way.
Prerequisites
General propaedeuticity applies.
Teaching Methods
The course is organised in lectures, in which students will be invited to actively participate.
For each macro-topic explained in class, documents (slides and possibly court cases and articles) will be made available on the DIR platform to integrate the topics covered.
Course attendance is recommended. Attendance is useful in order to acquire a greater mastery of labour law, legal vocabulary and the technique of interpreting the regulatory texts.
Additional Information
Students are invited to refer to the course page on DIR for supplementary lecture material as well as the detailed syllabus.
Assessment Methods
Written examinations to test knowledge of the law, the ability to process and organise acquired notions, and to apply the discipline in solving practical cases.
- In accordance with the CCL regulation, for attending students only, a written exemption test is administered at the end of the lecture schedule, with mainly multiple-choice questions. The questions will reflect the course content and issues outlined in class.
The test will last 45 minutes.
Failure to participate in the test, failure to pass it or rejection of the grade awarded will lead to the examination being conducted in the same way as for non-attenders.
- A written test with open-ended questions is administered during the ordinary examination for non-attending students or for attending students who did not participate in the exemption, failed it or refused the grade. The questions reflect the content of the course and the textbook.
The test will last 45 minutes.
Detailed Syllabus
The subject of the course is the employment relationship law. In particular, the course will deal with: labour law sources; the notions of subordination, self-employment and para-subordination; the organisation of the labour market and the establishment of relationships; decentralised production and other forms of company organisation; the typology of subordinate employment contracts (fixed-term contracts, part-time contracts, agency work, etc.); the employer's managerial power (general profiles, regulation of duties and transfer of workers, management of working hours, etc.); the power of control and disciplinary power; remuneration (constitutional profiles, notion and structure, automatic salary systems); the suspension of the employment relationship; the discipline of dismissals; the guarantees of the employee's rights.
Expected Learning Outcomes
At the end of the course, students will be familiar with the institutional notions of labour law. They will be able to orient themselves within the scope of labour law and critically discuss its contents. They will therefore be able to independently resolve the main legal questions that may arise in the context of the employment relationship management. Finally, they will be able to make appropriate use of specialist language and keep the knowledge and skills acquired during the course constantly updated.
