Course Contents
The seminar consists of the simulation of proceedings on a fictitious case before the European Court of Human Rights. The simulation consists of two phases: the first written phase, with the preparation of party pleadings; the second oral phase, with the presentation of party arguments.
Within the group that will attend the seminar, persons interested in participating in an international moot court competition will also be selected.
Reference Texts
The teaching material, generally consisting of normative, doctrinal and jurisprudential sources, will be partly suggested by the lecturer according to the subject of the simulation and partly identified by the participants themselves - through their own research - under the lecturer's supervision.
Learning Outcomes
In-depth knowledge of an area of international law, both substantive and procedural. Development of the ability to analyse and investigate a concrete case. Acquisition of logical and argumentative skills through the drafting of written pleadings and oral arguments. Development of the ability to work in a group. The teaching also aims to initiate the use of one or more legal databases for the retrieval of normative sources, case law and doctrinal materials, as well as the analysis of concrete legal cases in order to develop argumentative skills and the production of summary texts (pleadings/opinions).
Prerequisites
Basic knowledge of English to access doctrinal and case law materials. Excellent knowledge of English, written and spoken, for those interested in participating in the international moot court.
Teaching Methods
The seminar will be based on a series of meetings aimed at: a) analysing and discussing the fictitious case; b) organising the research and writing of the pleadings; c) drafting the written pleadings; d) preparing the oral discussion. Collaborative working methods (cooperative learning) will be promoted through a division into groups. Attendance is compulsory.

Assessment Methods
Assessment takes place during the seminar meetings and on the basis of written production and oral presentation, which are an integral and compulsory part of the seminar activity.
Detailed Syllabus
The programme includes the study of a fictitious case before the European Court of Human Rights. To this end, the meetings and materials provided will be in a first phase devoted to the Court's competences and functioning, the protection of some specific fundamental rights of the European Convention, as well as the requirements for admissibility of appeals. The simulated case will deal with one or more rights guaranteed by the Convention and will involve the study of the Court's jurisprudence, the mechanisms for establishing the responsibility of States and the prerequisites for lodging an appeal. Specifically the case is related to admissibility of a claim under subsidiarity requirements, the construction of a detention centre outside of the territory of the Convention and the rights affected by the use of facial recognition technology. All these aspects will then have to be consolidated in a written document (appellant's or respondent's brief) and arguments to be presented orally before a simulated Chamber of the Court.
Expected Learning Outcomes
Knowledge of the substantive and procedural profiles of the subject matter of the competition. Development of the ability to analyse and investigate a concrete case. Development of logical and argumentative skills. Ability to work in a group. The seminar activities are part of a training programme aimed at providing skills useful for developing the ability to interpret and apply the law, required by the world of the professions.
