The course focuses on the judicial protection against the acts and behaviors of public administrations, as well as the regulation of the liability of public administrations.

The administrative justice system is fundamental to guarantee respect for the rule of law, ensuring that illegitimate acts and behaviors of public administrations are sanctioned and give rise to liability for them and the competent officials. The Course aims to promote an in-depth knowledge of its fundamental institutes.

The course requires the successful completion of the exams in Administrative Law I and Civil Procedure Law.

The course combines between lectures and seminar-based in-depth analysis of case law. In the final part of the course a simulation of an administrative trial will be conducted.

For attending students, the assessment will be structured as follows:

- A written test with multiple-choice questions covering part of the program. Passing this test will exempt the student from that part of the program in the oral exam.
- An oral examination on the remaining part of the program, upon which the final grade will be based.
For non-attending students, the exam will consist solely of an oral examination on the entire course program.

Historical evolution of the Italian system of administrative justice; the “interesse legittimo” in its procedural aspects; the Constitutional principles concerning the Administrative process; the division of jurisdiction between ordinary and administrative judges; proceedings before the civil judge (ordinary jurisdiction over public administrations); the Code of Administrative Procedure and its general regulations; administrative appeals; the liability of public administrations and public officials.

The expected outcome is a solid and non-superficial understanding of the administrative justice system, the ability to comprehend the connections between its main components, and to deduce the useful implications for solving concrete cases.
